Practice Focus:
Brian is an experienced litigator and trial attorney specializing in entertainment-related and general business litigation.  He has represented clients in litigation involving contract, copyright, trademark, real estate and construction disputes.  In this day and age of litigation attorneys who never go to trial, Brian has the distinction of trying an average of two jury trials per year over the past several years, and winning most of them.  Prior to joining Tesser & Ruttenberg, Brian practiced with the large Los Angeles law firms Jeffer, Mangles, Butler & Marmaro and Jenkins & Gilchrist

Significant Matters:
Brian is currently representing Buddy Holly’s heirs in a multi-million dollar royalty dispute against MCA Records.

Very recently, Brian successfully represented the plaintiff in a breach of contract and fraud case in Federal Court wherein he obtained a jury verdict in excess of $369,000, including over $107,000 in punitive damages.

In addition, Brian successfully represented his client, the defendant, in a three week bench trial, wherein the court found no liability against his client on a $1.6 million construction client. 

Brian also successfully represented the plaintiff and cross-defendant in a two-week jury trial in a real estate dispute wherein his client was awarded a large verdict which included punitive damages. 

Brian obtained a complete reversal of two judgments against his client in a published opinion by the California Court of Appeal in the case of Gottlieb v. Kest (2006) 142 Cal.App.4th 110.

Activities:
Brian currently serves as a judge pro tempore for the Los Angeles Superior Court.

Brian was recently honored as a “Super Lawyer” by Los Angeles Magazine.

Personal:
In his free time, Brian enjoys playing the piano, tennis, softball, and rooting for his beloved but often heart-wrenching New York Jets.
